Prices for our Services are subject to change without notice. We reserve the right to modify or discontinue any Service without notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

Payment Terms

Payment terms will be outlined in your service agreement or contract. Typically, we require a deposit before beginning work, with the balance due upon completion of the project or according to an agreed-upon payment schedule for larger projects.

If you fail to make any payment when due, we reserve the right to suspend or terminate Services and may take legal action to recover unpaid amounts, including associated collection costs and attorney fees.

Warranties and Guarantees

Maximus Roofing provides workmanship warranties as specified in your service agreement or contract. Manufacturer warranties for materials are provided as per the manufacturer's terms. Warranty information will be provided to you upon completion of your project.

To maintain warranty coverage, you must follow any maintenance guidelines provided and must not allow unauthorized repairs or modifications to the roof system. Any alterations or repairs made by individuals not authorized by Maximus Roofing may void your warranty.

Limitation of Liability

In no event shall Maximus Roofing, its officers, directors, employees, or agents be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of our Services or website, whether based on contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Our total liability for all claims arising out of or relating to these Terms, our website, or Services shall not exceed the amount you paid to us for the Services over the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or consequential damages, so the above limitations may not apply to you.

Indemnification

Force Majeure

Maximus Roofing will not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to natural disasters, severe weather conditions, acts of God, strikes, lockouts, riots, acts of war, epidemics, pandemics, governmental regulations, fire, power failures, material shortages, or other similar events.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. Any dispute arising under or relating to these Terms or our Services shall be resolved exclusively in the state or federal courts located in Sacramento County, California.

Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions contained herein.

Termination

We may terminate or suspend your access to our website or Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the website and Services will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Entire Agreement

These Terms, together with our Privacy Policy and any service agreements or contracts, constitute the entire agreement between you and Maximus Roofing regarding our Services and your use of our website, and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
